These Terms of Service (“Terms”) apply to your access to and use of the Quench Australia website (the “Site”) and any purchases you make from us.

By accessing the Site or purchasing products from us, you agree to these Terms. If you do not agree, do not use the Site.

2) Eligibility and acceptable use

You must be at least 18 years old, or have permission from a parent or guardian, to make a purchase.

You agree not to misuse the Site, including attempting to interfere with security, scraping, or using the Site for unlawful purposes.

 

3) Products and general information

We sell hydration and wellness products. Product descriptions, ingredient lists, nutritional panels, and other information are provided for general information only.

No medical advice: Our products and content are not intended to diagnose, treat, cure, or prevent any disease. If you are pregnant, breastfeeding, have a medical condition, or take medication, you should consult a healthcare professional before using our products.

Allergies and sensitivities: You are responsible for reviewing ingredient lists and suitability for your needs before purchasing or consuming a product.

 

4) Orders and acceptance

When you place an order, you are making an offer to purchase. We may accept or reject your order at our discretion, including if a product is out of stock, we suspect fraud, there is an error in pricing, or your address cannot be serviced.

An order is accepted when we confirm dispatch, or otherwise confirm your order in writing.

 

5) Pricing, GST, and payment

All prices are in AUD unless stated otherwise. Prices generally include GST where applicable. Shipping fees are shown at checkout.

We may change prices at any time, but changes will not affect paid orders already placed.

Payments are processed by third-party payment providers. You authorise us (and our payment providers) to charge the payment method you provide.

 

6) Promotions, discount codes, and bundles

Promotions and discount codes are subject to conditions displayed at checkout or in marketing materials and may be changed or withdrawn at any time.

Unless stated otherwise:

• One code per order.
  
• Codes cannot be applied retrospectively.
  
• Discounts usually do not apply to shipping.
  
• Promotions may be limited to specific products, time periods, or customer types.
  
  

If a promotion is published in error, we may cancel affected orders and refund amounts paid.

 

7) Shipping and delivery (Australia only)

We currently ship to Australia only.

Dispatch and delivery timeframes are estimates only and may vary due to factors outside our control (carrier delays, peak periods, incorrect address details, access issues).

You are responsible for providing accurate delivery details. If a parcel is returned to us due to an incorrect address or failure to collect, we may charge a reshipment fee.

 

8) Title and risk

Title to products passes to you once full payment is received. Risk passes on delivery to the address provided.

 

9) Returns, refunds, and Australian Consumer Law

We comply with the Australian Consumer Law (ACL).

Under the ACL, you may be entitled to a repair, replacement, or refund if goods are faulty, not as described, or not fit for purpose. This applies regardless of any other policy.

Our returns and refunds process is set out in our Refund Policy (published on the Site), which forms part of these Terms.

 

10) Subscriptions and recurring orders (when offered)

 If we offer subscriptions or recurring deliveries (“Subscriptions”):

• By selecting a Subscription, you authorise us to charge your payment method on a recurring basis at the frequency shown at checkout.
  
• Your Subscription will continue until you pause, skip, or cancel it through your account portal (or as otherwise instructed on the Site).
  
• Changes or cancellations must be made before the cutoff time displayed in your account portal for them to apply to the next order.
  
• If a recurring payment fails, we may attempt to reprocess it and your order may be delayed or cancelled.
  
  

 

We may offer “first Subscription order” promotions from time to time. Those offers may have additional anti-misuse rules and eligibility limits, which will be stated at checkout and/or in the Refund Policy.

 

11) Product use and results

Individual experiences may vary. We do not guarantee specific outcomes from using our products.

Products are for personal use only, not for resale unless we agree otherwise in writing.

 

12) Intellectual property

All content on the Site (including branding, product names, packaging designs, images, and copy) is owned by or licensed to Quench and protected by intellectual property laws.

You may not copy, reproduce, modify, distribute, or exploit any Site content without our prior written consent.

 

13) User content and reviews

If you submit reviews, images, videos, or other content:

• You represent you own or have rights to that content.
• You grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and promotional purposes.
• You agree not to post content that is unlawful, misleading, defamatory, abusive, or infringes rights.
  
  

We may remove content at our discretion.

 

14) Third-party services and links

The Site may include third-party services and links. We are not responsible for third-party content, policies, or services.

 

15) Limitation of liability

To the maximum extent permitted by law, we exclude liability for indirect or consequential loss arising from use of the Site or products.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the ACL that cannot be excluded.

Where permitted, our liability is limited (at our option) to resupplying the goods or paying the cost of resupplying the goods.

 

16) Indemnity

You agree to indemnify us for losses, claims, and expenses arising from your breach of these Terms or misuse of the Site.

 

17) Privacy

Your use of the Site is also governed by our Privacy Policy.

 

18) Changes to these Terms

We may update these Terms by publishing a new version on the Site. Changes apply from the “Last updated” date.

 

19) Governing law

These Terms are governed by the laws of New South Wales, Australia, and you submit to the non-exclusive jurisdiction of the courts of New South Wales.
